  • I have often emphasized in Planning Commissions where I serve that the time to effect outcomes is not at the point of application, where the published rules win out over passions, but rather at the time the comp plans and zoning codes are written. And while small town zoning codes are like gold fields to P&Z lawyers, they also represent the best efforts of the citizens to guide their community’s development.

    So the question I ask of Dave is “How do we write a generic code years ahead of the PUC requests that protects something we do not even know needs protecting?”

    As for the 15% effect (15% of people within x yards) being refutable by invoking the StOlaf (relevant) and Carleton (irrevelant by distance?) experiences. This is an example of why statisticians do the math for medical researchers. The StOlaf experience is not comparable to the proposed sitings and inference on effects using these are not valid. Just as Dave recommends good counsel, so would I recommend better science research than this.
