The case will go to court, Nfld answers Waterford; Man says he’s not selling meth, he got a “two for one” deal; Memorial Day service and BTYR picnic

The City of Northfield maintains that the Orderly Annexation agreement with Waterford Township signed in 1981 is null and void.  Attorney for Northfield, Robert T. Scott, officially answered Waterford Township’s lawsuit stating “the City denies each and every allegation, matter, thing and inference contained in the plaintiff’s complaint”.  Waterford’s attorney, Mike Couri,explained in a nutshell, “they’re basically saying the agreement’s void and there was no authority for it to ever be enacted and it should be, in essence, killed by the court.  And the Township, of course, is saying the agreement is

still binding and should be enforced by the court”.  This will now begin the court process which has been put on a fast track.  Couri said this a pilot program established by the State to move cases along that are not “fact heavy”, saying, “ours is really more a legal issue rather than a he said she said”.   Dakota Co. Court could issue a summary judgement, which would cut out a trial.  Once that happens, either party has 60 days to appeal it to the Court of Appeals.  That process could take 9 months to a year, then it’s an option to appeal to the MN Supreme Court, which will decide whether or not to hear it.  About 10{b5761be34e80a16b6d0e4dabc1869c131a263f96a745c82bebdd3b8a4330bfa9} of those cases actually go to the Supreme Court. In 1981, Waterford alleges that the two entities signed an agreement that sought special legislation that they share “revenue” in perpetuity.  Northfield would pay Waterford tax reimbursement on the annexed land (formerly Sheldahl, now Multek) and legislators ratified it. Northfield disagrees and, in 2010, they stopped paying Waterford Township after nearly 38 years.  A case management conference is scheduled for July 10th.

Man says he’s not selling meth, he got a “two for one” deal 

A Woodbury man is in Rice County jail after a traffic stop by a Faribault police officer netted nearly $2,000 in cash and 63 grams of methamphetamine.  30 year old Jorge Luis Vargas Perez had a warrant out for his arrest in Hennepin County. After being placed in the squad car, Vargas Perez told the officer he’d like his money, he had cash in a wallet in the vehicle and in the console.  While looking for the money, a bill was found with meth residue which led to a search. Officers found the stash in the rear pocket of the passenger seat. Vargas Perez said it was his. He gets his drugs from a girl in the cities and usually buys one ounce for himself but this last time the girl offered him a two for one deal and he forgot it was there.  Vargas Perez is charged with 1st degree drug sale. Bail’s been set at $40,000 with conditions. His first court appearance is June 6th.  Vargas-perezCOMPLAINT (92)

Memorial Day service and BTYR picnic

Monday is Memorial Day, KYMN will be broadcasting the ceremony at Veterans Memorial Park off Hwy 3 beginning at 9am.  The public is encouraged to attend the service hosted by the Northfield American Legion and VFW posts. Immediately following the ceremony, the public is also invited to attend a picnic hosted by Beyond the Yellow Ribbon.  Organizer Dana Graham said it will be held in the shelter, so just walk on over. They’ll be serving hot dogs, pulled pork, chips and more. He added, “we want to do this for the community, we want to do this for our Veterans”.  The lunch is free but they will accept donations. Carrie Peterson is a veteran, a wife of a veteran and the mother of two active duty military.  She’s also a committee member.  She said, “it’s nice to support those families, the moms, the children, the family.  As they’re deployed, there are needs that arise, whether it’s a car need, something with their home.  And there’s a whole network of people that are willing to help in this community”.  Graham said BTYR wants veterans and active military families to know they’re here to support them with over 300 volunteers from all kinds of industries with a large variety of skill sets to offer.  Listen to their full interview on kymn.net.
