Dakota Co. Sheriff calls on the State to defend DNA collection

Dakota County Sheriff Tim Leslie won’t be taking DNA samples without a warrant.  Last week, the ACLU of Minnesota settled their civil case with the Sheriff who had been taking samples of defendants charged with certain violent crimes prior to convictions.   The ACLU filed suit in April against Sheriff Leslie on behalf of 68-year-old John David Emerson, of Rosemount, who faced a second-degree charge of assault with a dangerous weapon following an alleged road rage incident in October 2015 in Hastings. In 2005, MN Courts enacted a law which mandated Sheriffs throughout Minnesota to collect DNA (without a warant) seeing the value in identifying violent offenders.  Since then courts have gone back and forth on whether it was legal for them to do so.  While this law was previously held unconstitutional by the Minnesota Court of Appeals, a subsequent decision in 2013 by the U.S. Supreme Court declared a very similar law in Maryland to be constitutional. Based on that decision, Dakota County reinstituted its compliance with in 2015. In a joint press release, Leslie and Dakota County Attorney James Backstrom, said, in part, they still believe in the method but the statute in question has statewide impact and any potential costs associated with defending the law should be the responsibility of the state of Minnesota and not just the citizens of Dakota County.

Over $4,000 was raised in Northfield last Friday for the victims of the earthquakes in Mexico and Hurricane Maria in Puerto Rico.  About 125 people enjoyed a cultural exchange with native dancing, music and poetry put together by 5 women representing Puerto Rico, Mexico, Chile and Spain.  The event at the Northfield Middle School brought a couple of matching donors.  The dollars will be split in half.
